A is not guilty of any offence against the human victim. Section 79 of IPC provides that nothing is an offence which is done by a person who is justified by law, or who by reason of a mistake of fact in good faith believes himself to be justified by law, in doing it. If A had a valid permit or reasonably believed he was permitted to hunt deer in the sanctuary, he may claim protection under Section 79. The death resulted from a lawful activity (permitted hunting) done in good faith. A may face Wildlife Act violations for poaching, but not culpable homicide or murder for the accidental death.
