Election Commission of India and the Election Courts

Rajiv Kumar is the current Chief Election Commissioner of India. He was appointed on 15th May 2022.

The Election Commission of India was established on 25th January 1950.

The Election Commission of India is responsible for conducting elections to the Lok Sabha, Rajya Sabha, State Legislative Assemblies, Legislative Councils, Panchayats, and Municipalities.

The Election Commission of India consists of three members: the Chief Election Commissioner and two Election Commissioners.

The term of office of the Chief Election Commissioner is 6 years.

The qualification for becoming the Chief Election Commissioner is that the person must be a retired judge of the Supreme Court.

The Election Courts are responsible for hearing and deciding election petitions, resolving disputes related to elections, and punishing candidates and political parties for electoral malpractices.

The High Court has the original jurisdiction to hear election petitions.

An election petition must be filed within 45 days after the election results are declared.

The Election Court must decide an election petition within 6 months.

An election petition can be filed on the grounds of bribery, undue influence, personation, and other corrupt practices.

The punishment for electoral malpractices can include imprisonment, fine, disqualification from contesting elections, or all of the above.

A number of reforms have been proposed to strengthen the Election Commission of India, including increasing the number of Election Commissioners, granting more powers to the Election Commission, and bringing electoral reforms.
