The Elements of Crimes in the Rome Statute

The Rome Statute is the founding document of the International Criminal Court (ICC). It is a treaty that establishes the ICC and sets out its jurisdiction, powers, and procedures. The Rome Statute also contains a set of rules that govern the conduct of the ICC.

The mental element required for most crimes in the Rome Statute is intent. This means that the perpetrator must have had the purpose of committing the crime.

The principle of complementarity in the Rome Statute states that the ICC can only prosecute crimes if the national courts are unwilling or unable to do so. This means that the ICC is a court of last resort.

The ICC is facing a number of challenges, including a lack of cooperation from some states. However, the ICC is making progress in its investigations and prosecutions, and it is playing an important role in promoting accountability for international crimes.
