Legal Frameworks for Forced Migration

The Refugee Convention is the primary legal framework for the protection of refugees. It defines who is a refugee, sets out the rights of refugees, and establishes the obligations of states to protect refugees.

The UNHCR is the United Nations agency responsible for providing protection and assistance to refugees. It promotes the implementation of the Refugee Convention, coordinates the international response to forced migration, and resettles refugees in new countries.

The main difference between a refugee and an IDP is that refugees have crossed an international border, while IDPs have not. Refugees are fleeing persecution, while IDPs are fleeing natural disaster or conflict. Refugees have a right to seek asylum, while IDPs do not. Refugees are entitled to international protection, while IDPs are not.

The Global Compact on Refugees is a non-binding agreement that sets out a comprehensive framework for responding to the global refugee crisis. It was adopted by the United Nations General Assembly in 2018 and is intended to guide states in their efforts to protect and assist refugees.

Refugees today face a variety of challenges, including persecution, war and violence, natural disasters, climate change, and economic hardship. These challenges can make it difficult for refugees to find safety and rebuild their lives.

There is no single solution to the global refugee crisis. A comprehensive approach is needed that includes increasing funding for humanitarian assistance, promoting peace and stability in conflict-affected countries, addressing the root causes of displacement, and resettling refugees in new countries.
