Guardianship and Public Policy

Guardianship is a legal arrangement in which a person (the guardian) is appointed by a court to make decisions for another person (the ward) who is unable to make decisions for themselves.

In order to become a guardian, a person must be at least 18 years old, a citizen of the United States, and have a clean criminal record.

The duties of a guardian include providing care and support for the ward, managing the ward's financial affairs, and making decisions for the ward.

The rights of a ward include the right to be treated with dignity and respect, the right to make decisions about their own life, and the right to have their needs met.

The ethical issues surrounding guardianship include the potential for abuse of power by guardians, the conflict of interest between guardians and wards, and the lack of accountability of guardians.

The public policy issues surrounding guardianship include the need to protect the rights of wards, the need to ensure that guardians are qualified and accountable, and the need to provide support to guardians.

The future of guardianship is uncertain, but it is likely that the guardianship system will continue to be used to protect the rights of vulnerable adults, that it will be reformed to address the challenges it faces, and that it may be replaced by a new system of supported decision-making.
