Supreme Court and Same-Sex Marriage Law

In United States v. Windsor (2013), the Supreme Court ruled that Section 3 of the Defense of Marriage Act (DOMA), which defined marriage as a union between one man and one woman, was unconstitutional.

On June 26, 2015, the Supreme Court ruled in Obergefell v. Hodges that the fundamental right to marry is guaranteed to same-sex couples by both the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment.

Justice Anthony Kennedy wrote the majority opinion in Obergefell v. Hodges, which was joined by Justices Ginsburg, Breyer, Kagan, and Sotomayor.

Before the Supreme Court's decision in Obergefell v. Hodges, 36 states had legalized same-sex marriage, either through legislative action or court rulings.

The Obergefell v. Hodges ruling does not require religious organizations to perform same-sex marriages. It only requires states to recognize same-sex marriages performed in other states and to provide same-sex couples with the same federal benefits as heterosexual couples.

The plaintiffs in Obergefell v. Hodges argued that the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment guarantee the right to marry and that denying same-sex couples the right to marry violated these rights.

Loving v. Virginia (1967) is a landmark case in which the Supreme Court ruled that laws prohibiting interracial marriage were unconstitutional. While this case is related to marriage rights, it is not specifically related to same-sex marriage.

Civil union, domestic partnership, and registered partnership are all terms used to describe legal relationships between same-sex couples that provide similar rights and responsibilities as marriage, but without the use of the term 'marriage'.

Same-sex marriage can provide numerous benefits for same-sex couples, including increased access to health insurance and other benefits, improved financial stability, and greater social acceptance and recognition. However, it is important to note that same-sex couples may still face discrimination and prejudice in certain contexts.

Traditional marriage, biblical marriage, and natural marriage are all terms used to describe the belief that marriage should be limited to the union of one man and one woman.
