Arbitration Law: Enforcement of the Arbitration Award

In order for an arbitration award to be enforced, it must meet certain requirements, including being in writing and signed by the arbitrator, being final and binding, and being issued by a competent arbitrator.

The Convention on the Recognition and Enforcement of Foreign Arbitral Awards, also known as the New York Convention, aims to provide a uniform framework for the enforcement of foreign arbitration awards, promote the use of arbitration as a means of resolving international disputes, and facilitate the recognition of foreign arbitration awards in different countries.

China is not a party to the New York Convention, and therefore, the Convention is not applicable in China.

Under the New York Convention, the time limit for seeking the enforcement of an arbitration award is 3 years from the date the award was issued.

Under the New York Convention, the enforcement of an arbitration award may be refused if the award was obtained by fraud or corruption, if it is contrary to public policy, or if it is in violation of the fundamental principles of justice.

The United States is not a party to the Model Law on International Commercial Arbitration, and therefore, the Model Law is not applicable in the United States.

The Model Law on International Commercial Arbitration aims to provide a uniform framework for the conduct of international commercial arbitration, promote the use of arbitration as a means of resolving international commercial disputes, and facilitate the recognition and enforcement of international arbitration awards.

Under the Model Law on International Commercial Arbitration, an arbitration agreement is valid if it is in writing, signed by the parties, and specifies the subject matter of the dispute.

Under the Model Law on International Commercial Arbitration, there is no time limit for commencing arbitration proceedings.

Under the Model Law on International Commercial Arbitration, an arbitration award may be set aside if it was obtained by fraud or corruption, if it is contrary to public policy, or if it is in violation of the fundamental principles of justice.

In the United States, an arbitration award can be enforced by filing a motion to confirm the award either in federal court or in state court.
