Dance and the Right to Equality Before the Law

Article 15(1) of the International Covenant on Economic, Social and Cultural Rights states that everyone has the right to participate in cultural life, including the enjoyment of the arts and the freedom to participate in scientific, literary or artistic production.

Article 14 of the Constitution of India states that the State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.

Article 15(1) of the Constitution of India states that the State shall not discriminate against any citizen on grounds only of religion, race, caste, sex, place of birth or any of them.

The principle of non-discrimination prohibits the State from treating different groups of people differently without a reasonable justification. This principle is enshrined in Article 14 of the Constitution of India.

In the landmark case of Navtej Singh Johar v. Union of India (2018), the Indian Supreme Court held that the right to dance is a fundamental right protected under Article 19(1)(a) of the Constitution, which guarantees the right to freedom of expression.

The Rights of Persons with Disabilities Act, 2016 is an Indian law that prohibits discrimination against persons with disabilities and ensures their equal opportunities, protection of rights, and full participation in society.

Article 30 of the Convention on the Rights of Persons with Disabilities (CRPD) states that persons with disabilities have the right to participate in cultural life, including dance, on an equal basis with others.

The Scheme for Promotion of Art and Culture is an Indian government scheme that provides financial assistance to artists and cultural workers, including dancers, to promote and develop their artistic skills and talents.

Odisha is the only Indian state that has a dedicated policy for the promotion and development of dance. The Odisha Dance Policy, 2015 aims to preserve and promote the rich dance heritage of the state and to provide support to dancers and dance organizations.

The National Dance Festival is an annual dance festival organized by the Ministry of Culture, Government of India, to celebrate the diversity of dance forms in the country. The festival features performances by dancers from all over India, representing different dance styles and traditions.
