Wakf in Muslim Law

Wakf is a legal concept in Muslim Law that refers to the permanent dedication of property for a religious or charitable purpose. The property is held in trust by a mutawalli (trustee) and the income generated from the property is used to support the intended purpose.

Wakf can be classified into two main types: Public Wakf and Private Wakf. Public Wakf is dedicated to the benefit of the general public, such as mosques, schools, and hospitals. Private Wakf is dedicated to the benefit of a specific individual or family.

The essential conditions for a valid Wakf are declaration of intention to create a Wakf, subject matter of the Wakf (property), and mutawalli (trustee). Registration of the Wakf deed with the government, approval of the Wakf by the court, and payment of stamp duty are not essential conditions.

Both Muslims and non-Muslims can create a Wakf. There is no restriction based on religion or age.

The mutawalli is responsible for managing and administering the Wakf property, collecting and distributing the income from the Wakf property, and representing the Wakf in legal proceedings.

The mutawalli cannot sell or mortgage the Wakf property under any circumstances. The Wakf property is considered to be inalienable and cannot be transferred or encumbered.

The income generated from the Wakf property is used to distribute among the beneficiaries of the Wakf, maintain and repair the Wakf property, and pay the mutawalli's salary.

A Wakf cannot be terminated under any circumstances. Once a Wakf is created, it becomes irrevocable and perpetual.

The Wakf Act, 1995 is the primary legislation governing Wakf in India. It provides a comprehensive framework for the administration and management of Wakf properties.

The Central Wakf Council is a statutory body established under the Wakf Act, 1995. It advises the government on matters relating to Wakf, supervises the administration of Wakf properties, and resolves disputes related to Wakf.

A Wakf is irrevocable, while a trust is revocable. A Wakf is created for a religious or charitable purpose, while a trust can be created for any purpose. A Wakf is governed by Muslim law, while a trust is governed by general law.

A Wakf cannot be created orally. It must be created in writing and registered with the appropriate authorities.

Both Muslims and non-Muslims can benefit from a Wakf. There is no restriction based on religion.

The doctrine of cy-près allows the court to modify the terms of a Wakf if the original purpose becomes impossible or impracticable. This is done to ensure that the charitable intention of the founder of the Wakf is fulfilled.
