Marriage in Muslim Law

The primary objective of marriage in Islam is to create a family and raise children. It is seen as a sacred union that brings two people together to fulfill their natural desire for companionship and procreation.

Nikah is the legal term for marriage in Islam. It is a contract between a man and a woman that is witnessed by two Muslim witnesses.

A valid Nikah requires the following essential elements: offer and acceptance, presence of two Muslim witnesses, payment of Mahr, and consent of the bride and groom.

Mahr is a gift given by the groom to the bride as a token of his love and commitment. It is an essential element of a valid Nikah and is considered the bride's right.

Mahr serves multiple purposes in Islamic marriage, including compensating the bride for the loss of her virginity, providing financial security for her, symbolizing the groom's commitment to the marriage, and ensuring that the bride is treated with respect and dignity.

There are four main types of Mahr: Prompt Mahr (paid immediately to the bride), Deferred Mahr (paid at a later date), Mixed Mahr (a combination of Prompt and Deferred Mahr), and Symbolic Mahr (a token gift of little monetary value).

Witnesses play a crucial role in an Islamic marriage. They ensure that the marriage is conducted in accordance with Islamic law, provide legal proof of the marriage, and protect the rights of both the bride and groom.

A valid marriage in Islam requires the consent of both parties, legal capacity to marry (i.e., being of sound mind and having reached the age of puberty), and the absence of any legal impediments, such as close blood relations or existing marriages.

The Wali in an Islamic marriage is the guardian of the bride. He is responsible for representing her interests and giving his consent to the marriage contract.
