Indian Disability Law and Rights

The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 is the primary legislation in India that addresses the rights of persons with disabilities. It provides for equal opportunities, protection of rights, and full participation of persons with disabilities in society.

According to the Persons with Disabilities Act, 1995, 'disability' means any physical or mental impairment that substantially limits one or more major life activities. Major life activities include activities such as walking, seeing, hearing, speaking, breathing, learning, working, and performing manual tasks.

The Persons with Disabilities Act, 1995 guarantees a wide range of rights to persons with disabilities, including the right to equality and non-discrimination, the right to life and personal liberty, the right to education, the right to employment, and the right to participate in cultural and recreational activities.

The National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities is a statutory body established under the National Trust Act, 1999. Its role is to provide financial assistance, vocational training and employment opportunities, promote research, and provide legal aid and advocacy services to persons with disabilities.

The Mental Health Act, 1987 aims to provide for the treatment and care of persons with mental illness, protect the rights of persons with mental illness, and promote mental health awareness and prevention.

Under the Mental Health Act, 1987, a person can be involuntarily hospitalized only if they are a danger to themselves or others.

The Rehabilitation Council of India is a statutory body established under the Rehabilitation Council of India Act, 1992. Its role is to regulate the training and practice of rehabilitation professionals, promote research in the field of rehabilitation, and provide vocational training and employment opportunities to persons with disabilities.

The National Policy for Persons with Disabilities, 2006 aims to provide a comprehensive framework for the welfare of persons with disabilities, promote their inclusion in society, and ensure their equal participation in all aspects of life.

The Rights of Persons with Disabilities Act, 2016 recognizes the rights of persons with disabilities on an equal basis with others, prohibits discrimination against persons with disabilities, provides for reasonable accommodation for persons with disabilities, and establishes a National Commission for Persons with Disabilities.

The National Commission for Persons with Disabilities is responsible for monitoring the implementation of the Rights of Persons with Disabilities Act, 2016, advising the government on matters relating to disability, promoting the rights of persons with disabilities, and providing legal aid and advocacy services to persons with disabilities.
