Election Commission of India and the Election Offences

Rajiv Kumar is the current Chief Election Commissioner of India, having assumed office on 15th May 2022.

The Election Commission of India was established on 25th January 1950, under Article 324 of the Indian Constitution.

The Election Commission of India is responsible for conducting elections, delimiting constituencies, registering political parties, and regulating election finance.

The Chief Election Commissioner has a term of office of six years, or until they reach the age of 65, whichever is earlier.

Bribing voters during an election is punishable with imprisonment for up to one year, or a fine of up to Rs. 1,000, or both.

Impersonating a voter during an election is punishable with imprisonment for up to three years, or a fine of up to Rs. 2,000, or both.

Using undue influence on voters during an election is punishable with imprisonment for up to one year, or a fine of up to Rs. 1,000, or both.

Booth capturing during an election is punishable with imprisonment for up to seven years, or a fine of up to Rs. 5,000, or both.

Destroying or damaging election materials is punishable with imprisonment for up to three years, or a fine of up to Rs. 2,000, or both.

Interfering with the counting of votes during an election is punishable with imprisonment for up to one year, or a fine of up to Rs. 1,000, or both.

Declaring false results during an election is punishable with imprisonment for up to three years, or a fine of up to Rs. 2,000, or both.

Using religion or caste to influence voters during an election is punishable with imprisonment for up to three years, or a fine of up to Rs. 2,000, or both.

Promoting enmity between different groups of people during an election is punishable with imprisonment for up to three years, or a fine of up to Rs. 2,000, or both.
