Rajya Sabha - Class VII

The Union Council of Ministers continues in office as long as they enjoy the confidence of a majority of members in the Lok Sabha. The moment a vote of no confidence is passed against them they have to quit office.

The
Vice-President of India is the ex-officio Chairman of the Rajya Sabha, who
presides over its sessions. The Deputy Chairman, who is elected from amongst
the house's members, takes care of the day-to-day matters of the house in the
absence of the Chairman.

Money
Bills can be introduced only in Lok Sabha. Money bills passed by the Lok Sabha
are sent to the Rajya Sabha. The Rajya Sabha may not amend money bills but can
recommend amendments. To make sure that Rajya Sabha doesn't amend the bill by
adding some non-money matters, the Lok Sabha Speaker certifies the bill as a
money bill before sending it to the upper house, and the decision of the
Speaker is binding on both the Houses. A money bill must be returned to the Lok
Sabha within 14 days or the bill is deemed to have passed both houses in the
form it was originally passed by the Lok Sabha.

Article 63 of Indian Constitution states that there shall be a Vice-President of India. The Vice-President acts as President in the absence of the President due to death, resignation, impeachment, or other situations. The Vice-President of India is also ex officio Chairperson of the Rajya Sabha.

The Vice President is not a member of Rajya Sabha but its ex-officio Chairman. He has no right to vote and is entitled to the salary and allowances in the capacity of the Rajya Sabha Chairman. Rajya Sabha can move bills, resolution and motion only after his consent.

The members nominated by the President are persons having special knowledge or practical experience in respect of such matters as literature, science, art and social service.

The Fourth Schedule to the Constitution provides for allocation of seats to the States and Union Territories in Rajya Sabha.  The allocation of seats is made on the basis of the population of each State.  Consequent on the reorganization of States and formation of new States, the number of elected seats in the Rajya Sabha allotted to States and Union Territories has changed from time to time since 1952.

The following matters are not affected in case of dissolution of the Lok Sabha:

• A bill originating and pending in the Rajya Sabha.
• A joint sitting of Parliament if notification of such a sitting has been given before the dissolution.
• Bills passed by both Houses and sent to the President for his assent.
• Bills returned by President for reconsideration.
  

Before the Constitution 70th amendment Act, 1992, Article 54 relating to the election of the President provided for an electoral college consisting only of the elected members of Parliament as well as the legislative assemblies of the States (not of Union Territories). The amendment provide for inclusion of members of legislature of Pondicherry and Delhi in representing these Union Territories in Rajya Sabha.

The Rajya Sabha (upper house of the Indian Parliament) is a continuing chamber which means it is a permanent body and cannot be dissolved although one-third of its members retire every second year.

The Deputy chairman or Vice-chairman of the Rajya Sabha is elected by the Rajya Sabha itself from amongst its members. It means that one has to be the member of Rajya Sabha for election to the post of the Vice Chairman.

The Vice-President of India is ex officio Chairman of Rajya Sabha. While the workplace of the Chairman is empty, or amid any period when he acts or discharges the function of President, the Deputy Chairman of Rajya Sabha plays out the obligations of the workplace of the Chairman. The members of the Lower House of the Parliament(Lok Sabha) are directly elected by the people from the territorial constituencies in the State. From one constituency only one representative is elected. The election is based on the principle of Universal Adult Franchise. Every Indian citizen who is above 18 years of age is eligible to vote at such elections. Accordingly the representatives of the Union territories are chosen by direct election. The President is empowered to nominate two members from Anglo Indian Community.

Council of States (Rajya Sabha) is composed of not more than 259 members out of which 238 are to be representatives of States and Union Territories and 12 are nominated by the president of India from amongst persons who have special knowledge or practical experience in respect of such matters as literature, science, art and social service.

The Presiding officer of the Rajya Sabha is known as the Chairman. The vice-president of India is the ex-officio(by the status) chairman of the Rajya Sabha. The Chairman of Rajya Sabha enjoys the same position and power in all matters as that of Speaker in Lok Sabha.

A money bill can only be introduced in the Lok Sabha and that too on the recommendation of the President. The Rajya Sabha has limited powers with regard to money bill. It cannot reject or amend a money bill but can provide recommendations. The President can give his assent or withhold his assent on money bill but he cannot return the bill for reconsideration Generally the president gives his assent to the bill as it was introduced with his prior permission.

The Rajya Sabha is presided over by the Vice President of India who is an ex officio chairman (chairman of rehta sabha by being in the post of vice president) of the Rajya Sabha. He is not a member of Rajya Sabha.

Due to it's federal character, Rajya Sabha has been given two exclusive powers that are not enjoyed by the Lok Sabha. One of which is, it can authorise the Parliament to create new All-India Services common to both Centre and State. The Rajya Sabha also has the power that it can authorise the Parliament to make laws on a subject enumerated in the State List.
