GK (Indian Constitution)

The Constitution of India was originally drafted in English and enacted in 1949. While it has been translated into Hindi and other regional languages, the authoritative original text was in English. The English version remains the primary legal reference.

Article 394A states that the Hindi translation of the Constitution, as adopted by Parliament, is the authoritative text. This means the Hindi version has legal authority equal to the English original for all official purposes.

The 47th Amendment Act 1984 added a new provision to Article 376 to protect municipalities that existed before the Constitution commenced. This ensured continuity of local governance structures that were already in operation.

Ward Committees are mandatory bodies in municipalities with populations over 3 lakh, as per the 74th Amendment. They function at the municipal level to decentralize urban governance and ensure local representation.

Article 343D defines a metropolitan area as having a population of ten lakhs (1 million) or more, or if the government declares it as such. This threshold is used for governance planning and administrative purposes.

The Constitution was signed by Constituent Assembly members in both Hindi and English on January 21, 1950. Both versions were authenticated simultaneously, reflecting India's linguistic diversity from the outset.

Article 343(1) of the Constitution declares Hindi in Devanagari script as the official language of the Union. However, it also allows continued use of English for official purposes for 15 years initially, which has been extended.

President's Rule under Article 356 requires approval by both Houses of Parliament within two months. Parliament must also approve every six months for its continuation. This makes Parliament the authorizing body.

Article 243U mandates that municipalities have a five-year term from the date appointed for their first meeting. However, they can be dissolved earlier, and elections must be completed before the five-year period expires.

Article 356 is the emergency provision for 'failure of constitutional machinery' in a state. It allows President's Rule if the state cannot function per the Constitution - commonly known as President's Rule.

Under Article 356, the Governor acts on the President's discretion and is not bound by the advice of the Chief Minister and Council of Ministers. This is because the state government is deemed to have failed.

The Indian Constitution currently has 12 Schedules, up from the original 8. The 9th Schedule was added in 1951, 10th in 1978, 11th in 1976 (dealing with anti-defection), and 12th in 1992 for Panchayati Raj institutions.

Under Article 356, the President imposes President's Rule in a state based on the Governor's report about failure of constitutional machinery. The Governor is the constitutional head who assesses the state's situation and reports to the President.

Article 394 contains the short title clause stating 'This Constitution may be called the Constitution of India.' It appears near the end of the Constitution and deals with its commencement and title.

Under Article 356, a President's Rule proclamation must be approved by Parliament within 2 months. If not approved, it automatically ceases to operate after 6 months from the date of proclamation.

Both S.R. Bommai (1994) and State of Rajasthan (1977) judgments established that the Union Government cannot dismiss a state government solely because the ruling party lost the Lok Sabha election. This prevents political misuse of Article 356.

Article 246 provides the framework for distributing legislative powers through the Union List, State List, and Concurrent List. It defines the subjects on which Parliament and State Legislatures can make laws.

The State List under the Seventh Schedule of the Constitution contains 66 subjects on which state legislatures have exclusive legislative powers, including police, public health, agriculture, and local government.

The Union List under the Seventh Schedule contains 97 subjects on which Parliament has exclusive legislative authority, including defense, foreign affairs, banking, currency, and interstate commerce.

Under Article 246 of the Constitution, both Parliament and State Legislatures can make laws on subjects in the Concurrent List. In case of conflict between Union and State laws on a concurrent subject, Central law prevails.

Under Article 356, Parliament must approve President's Rule within two months of proclamation. If Parliament does not approve, the proclamation lapses. This provides parliamentary check on executive power.

The Concurrent List under the Seventh Schedule contains 47 subjects on which both Parliament and State Legislatures can make laws, including education, marriage and divorce, bankruptcy, and labor welfare.

Under Article 246, Parliament has exclusive power to make laws on all subjects in the Union List. This includes areas of national importance like defense, foreign affairs, currency, and interstate trade.
