Indian Constitution

The Indian Constitution has 12 Schedules. These were added at different times - the original constitution had 8 schedules, and 4 more were added subsequently through amendments.

The President nominates 12 members to the Rajya Sabha from persons distinguished in fields such as art, literature, science, and social service. These members bring expertise from their respective domains to the Upper House.

The Constituent Assembly of India was established on December 9, 1946. This body was tasked with drafting the Constitution of independent India, marking the beginning of the constitution-making process.

The first meeting of the Constituent Assembly of India was held on December 9, 1946. This was the same day it was established, with Sachidanand Sinha elected as the temporary president.

The National Flag was adopted by the Constituent Assembly on July 22, 1947. This date is significant as it came just before India's independence. The flag's adoption was a key step in the nation-building process, symbolizing the newly independent India's identity and sovereignty.

The Constitution of India was adopted by the Constituent Assembly on November 26, 1949. This date is celebrated as Constitution Day. The Constitution came into force on January 26, 1950, which is celebrated as Republic Day. November 26, 1949 marks the final adoption, not enforcement.

Under Article 109, the Rajya Sabha must return a money bill within 14 days of receiving it from the Lok Sabha. This time limit applies whether Rajya Sabha recommends amendments or simply returns the bill without changes. If Rajya Sabha does not return the bill within 14 days, it is deemed to have been passed by both Houses.

The preamble has been amended only once through the 42nd Constitutional Amendment in 1976, which added the words 'socialist', 'secular', and 'integrity'. The original preamble remained unchanged from 1949 until this amendment, and no further amendments have been made since 1976.

National Emergency under Article 352 has been declared three times in India: in 1962 (during China war), 1971 (during Pakistan war), and 1975 (the controversial Emergency period). These were the only instances when the President proclaimed a national emergency invoking this constitutional provision.

The Constitution of India came into force on January 26, 1950, which is celebrated as Republic Day. The Constituent Assembly adopted it on November 26, 1949, but its enforcement began on January 26, 1950. This date was chosen because it was the anniversary of Purna Swaraj Day (1930).

The Vice President of India is the ex-officio Chairman of Rajya Sabha under Article 64. This means the Vice President presides over Rajya Sabha sessions by virtue of their office. The Vice President can only vote in case of a tie, not otherwise.

Under Article 78, every decision of the Cabinet is communicated to the President in the name of the Prime Minister. However, executive actions are taken in the name of the President. The question phrasing is slightly ambiguous but refers to the constitutional principle that the President acts on the aid and advice of the Council of Ministers.

Under Article 123, the President has the power to promulgate ordinances during the recess of Parliament. An ordinance has the same force as an Act of Parliament but must be approved by Parliament within 6 weeks of reassembly. This power is exercised on the advice of the Council of Ministers.

Under Article 56(1), the President can resign by writing under their hand addressed to the Vice President of India. This provision ensures a proper constitutional mechanism for the President's resignation. The resignation takes effect from the date it is received by the Vice President.

Under Article 75, the Prime Minister is appointed by the President of India. The President appoints the leader of the majority party or coalition in the Lok Sabha as Prime Minister. Other Ministers are appointed by the President on the advice of the Prime Minister.

The Governor is the constitutional head of a state in India, analogous to the President at the union level. The Governor acts on the advice of the Council of Ministers headed by the Chief Minister, similar to how the President acts on the advice of the Prime Minister and Cabinet.

The Governor of a state is appointed by the President of India under Article 155 of the Constitution. This appointment is made on the advice of the Prime Minister and the Union Council of Ministers, maintaining the federal structure.

The Prime Minister presides over the meetings of the Council of Ministers as the head of the government. The PM sets the agenda, guides discussions, and ensures coordination among different ministries, making the cabinet function as a cohesive team.

The Speaker of Lok Sabha presides over joint sittings of both Houses under Article 118 of the Constitution. Joint sittings are called to resolve deadlocks between Lok Sabha and Rajya Sabha on ordinary bills, and only the Speaker (not the President or Vice President) can preside.

The Prime Minister is the chief spokesman of the government in Parliament. The PM answers questions, makes statements, clarifies policies, and defends government decisions in both Houses, serving as the primary channel of communication between the government and Parliament.

Article 53 of the Constitution vests executive powers of the Union in the President, who exercises these powers on the advice of the Prime Minister and Council of Ministers. This creates the constitutional framework where the President is the formal executive while the PM is the real executive.

The Prime Minister is the head of the government, as opposed to the President who is the head of the state. The PM leads the executive branch, forms the government, and is responsible for all policy decisions and administration.

Ministers are appointed by the President on the advice of the Prime Minister. While the Constitution says the President appoints ministers, in practice, the President acts on the PM's recommendation - the PM selects who will be in the Cabinet.
