The Indian Constitution borrowed the provisions concerning suspension of fundamental rights during national emergency from the German (Weimar) Constitution. Article 48 of the Weimar Constitution allowed suspension of fundamental rights during emergencies. Similarly, Articles 358 and 359 of the Indian Constitution allow suspension of fundamental rights during national emergency. The emergency powers themselves draw from multiple sources, and the presidential election method and federal structure have different origins.
