Under Section 68 of the Indian Contract Act, 1872, a minor is not liable to repay for necessaries supplied. However, the supplier has a right to be reimbursed from the minor's property. Necessaries include things suitable to the minor's condition in life and actual requirements (food, clothing, education, shelter). The minor's personal liability is excluded, but property liability remains. This balances protection of minors with fairness to suppliers of essential goods and services.
